Terms & Conditions

mxData’s ("we" or "mxdata’s”) service, TrafficTV (the "Service" or “TrafficTV”) is made available to you ("you"), under the following terms and conditions as amended from time to time by mxData, and any additional or supplementary guidelines or rules applicable to the Services (the "Agreement"). The current version of this Agreement will be posted on www.mxdata.co.uk

If you break this Agreement we may suspend or terminate your ability to use the Service.

1.1 Obligations of mxData

  1. To provide demonstration software to the Affiliate for handsets supporting TrafficTV
  2. To provide images and collateral to the Affiliate where appropriate and available
  3. Bespoke collateral can be delivered on request at cost
  4. To set up & run a bespoke method of delivery of the TrafficTV software for each channel
  5. To enable monitoring of the licenses sold via a secure web page
  6. To actively continue to market TrafficTV in appropriate media

1.2 Obligations of the Affiliate

  1. To supply the methods of activating the TrafficTV service only under the procedures specified by mxData.
  2. All information relating to the TrafficTV licences, installation methods and procedures is confidential and the Affiliate undertakes not to disclose such information to any third party without the written consent of mxData.
  3. To indemnify mxData against any third party claims arising from breaches of this Agreement including but without limitation any issues concerning the validity of the traffic content.

1.3 Reportage

The secure log on supplied to each affiliate will show the following information:

  • Number of SMS messages sent to the specific affiliate channel
  • Number of Downloads split between channels
  • Number of Quarterly purchases
  • Number of Annual purchases
  • Value of the purchases to date

1.4 Pricing

mxData reserves the right to change the pricing of the TrafficTV product at any time. Current pricing: All prices quoted in this Agreement include VAT.

1.5 Revenue

  • Up to 500 new subscribers 20% per new customer
  • 501-2000 new subscribers 22% per new customer
  • 2001+ new subscribers (Apply)

1.6 Invoicing

  • Minimum invoicing amount £50
  • Maximum frequency monthly.
  • Payment terms 30 days.
  • Simply email support@traffictv.co.uk when you want payment

1.7 Termination of Agreement

This Agreement may be terminated by mxData giving written notice to the Affiliate upon:

  1. Receivership, bankruptcy or liquidation of the Affiliate.
  2. In the event the Affiliate fails to actively promote the sale of TrafficTV.
  3. material breaches of the terms of this Agreement.
